It does not introduce a commercial target. It allows a reader to recognize whether the use they make of AI already crosses a responsibility boundary. Exposure does not depend on technical sophistication, but on the usage context and the real impact of the responses produced.

The central exposure criterion

An organization is exposed to interpretive risk as soon as an AI response:

  • influences a human or automated decision;
  • is used as if it were reliable or enforceable;
  • is attributable, explicitly or implicitly, to the organization;
  • can be challenged after the fact by a third party (client, employee, partner, regulator).

Exposure is not linked to the tool, but to the actual use of the response.

Affected departments and functions

Legal and compliance

Exposure as soon as an AI response intervenes in a context where enforceability, proof, or explicability become necessary. Risk appears when the justification chain cannot be reconstructed.

Risk and audit

Exposure when decisions rely on plausible responses without a clear perimeter, without source hierarchy, or without explicit non-response conditions.

Human resources

Exposure as soon as AI participates in inferences, rankings, recommendations, or summaries likely to influence a decision concerning a person.

Customer support and user experience

Exposure when AI responds in place of a human in commitment contexts: conditions, guarantees, refunds, contractual interpretations, implicit promises.

Communications, marketing, and brand

Exposure when a public response produced or relayed by AI is interpreted as an official position, a declared expertise, or verified information.

Product, data, and internal systems

Exposure when AI synthesizes, interprets, or arbitrates between heterogeneous internal sources, creating surface coherence used to drive actions.

Typical cases of silent exposure

Interpretive risk is often invisible until it materializes.

  • An “informational” chatbot used as a source of truth.
  • An AI summary interpreted as faithful when it arbitrates between contradictory sources.
  • A plausible response used for lack of an explicit alternative.
  • An absence of signal interpreted as confirmation.
  • A non-response not anticipated, therefore replaced by a default response.

What is not determinative

Certain factors are often invoked but do not suffice to eliminate risk:

  • the presence of a human “in the loop” without clear validation criteria;
  • the addition of generic disclaimers;
  • the use of internal sources without hierarchization;
  • trust in the plausibility or fluency of responses.

Recognizing exposure before the incident

The structuring question is not “does AI make mistakes?”, but:

  • what happens if this response is challenged?
  • who must explain why it was produced?
  • on what basis could a non-response have been chosen?
